For all those wives who are considering what is an appropriate amount and period of spousal maintenance and for all those husbands who may fear it there has recently been a definitive case when 11 applicable principles in respect of spousal maintenance have been pulled together. This is likely to be very influential in the years to come given that the groundbreaking Judge Mostyn pulled together all existing case law as well as the views of the Law Commission to make new guiding principles clear.
It appears generally that maintenance is now swinging towards a needs based assessment and there is also a greater movement towards limited terms rather than open ended terms. That said the question of review at the end of such a limited term of maintenance may be flexibly interpreted if the needs dictate.
