Company Valuations and Judges Discretion in Finanacial Proceedings
In another Court of Appeal decision in December 2018 a Wife’s claim for a recalculation of her winnings to include an extra money award failed. The Wife’s legal team had argued that the Court had taken the wrong company valuation and looked at the wrong percentages of ownership therein. All of that was dismissed by The Court of Appeal who said that in a general discretion it was quite right to take “an overarching view” as to contributions and value of company. It is however noteworthy that the Higher Court was supporting Mr Justice Mostyn, who is a very influential Judge at the moment. So there does appear to be more than a suggestion of Higher and Lower Courts supporting not only the importance of “judicial discretion” but also the Court system.
